This Privacy Policy ("Privacy Policy") explains how Murchison-Hume PTY LIMITED (referred to as "MH", “we” “us” or “our”) uses personal information, including yours (individually and collectively "Personal Information") and applies to all people and companies who register or visit this site, www.murchison-hume.com (“our Site”) on or after the Effective Date above. 1. Types of Personal Information
We Collect Personal Information is information that can be used to identify, locate, or contact an individual. It also includes other information that may be associated with Personal Information. We collect the following types of Personal Information:
  • Contact Information that allows us and other addresses at which you receive communications from or on behalf of MH.
  • Relationship Information that helps us to understand who you are and what types of offers you might like. This includes such things as lifestyle information; location information related to your state/province, city, or neighborhood; areas of interest, the types of deals that interest you, information collected from social media interactions (such as via Facebook Connect, our Twitter and Facebook pages) demographic information (such as birth date, age, gender); information about persons for whom you have purchased our Products as gifts or who’ve bought our Products as gifts for you; and, information about friends who refer you or who you’ve referred to us.
  • Transaction Information about how you interact with MH, such as the Products you view and purchase; other information about how you use the Sites, email, other communications and applications; and, how you interact with our business partners and service providers. • Financial Account Information as needed to process payments for Products that you buy, such as your credit or debit card number, expiration date, billing address and card verification number.
2. How MH Collects Personal Information
We ask you for Personal Information (including Contact Information, Relationship Information, and Financial Account Information) when you register, subscribe, create an account, contact us, purchase our Products or otherwise interact with the Sites. We collect Transaction Information when you use our Site. For example, we may track the Products you view or purchase and the comments you make to Communities (Communities is defined and discussed in section 11, below). We use cookies and related technologies to collect information about your computer and your interaction with the Sites and our business partner websites. You can read more about cookies and other technologies in the Cookies and Related Technologies section, which is section 5 below. We also collect Transaction Information if you contact us via telephone, email, text, postal mail, fax, social media interaction or other methods of communication, such as for customer support purposes. We collect information that you provide us about other people when you purchase our Products as gifts, including those persons' Contact Information and Relationship Information. We create transaction records of your gift to those persons. If you use a social media platform, Communities or other method of communication to interact with MH or the Sites, that application may have a specific privacy statement that governs the use of Personal Information related to that application. You should find and read that application, as our Privacy Policy does NOT apply to that application. We may receive additional Personal Information from third parties. We may use this Personal Information to enhance other information we have about you to help us better understand you and to otherwise enhance the Sites or our Products.
3. How MH Uses Personal Information
MH uses Personal Information to:
  • Operate and improve the Sites;
  • Open an online account for you;
  • Provide customers with offers for Products and for products and services from participating merchants including but not limited to offers based on things such as stated and anticipated customer interests, personal characteristics or location;
  • Facilitate and process orders for our Products including but not limited to their purchase and shipping;
  • Evaluate eligibility of customers for certain products or services;
  • Evaluate the types of offers, products or services that may be of interest to customers;
  • Track our customers’ purchasing habits of our Products and perform other analytics;
  • Manage and develop our business and operations;
  • Provide customer support, including to our merchants or business partners;
  • Communicate and provide additional information that may be of interest to you about MH and our merchants and business partners, such as MH news, special offers and coupons, announcements and marketing materials;
  • Send you reminders, technical notices, updates, security alerts and support, administrative messages, service bulletins and marketing information;
  • Provide advertisements to you through the Sites, email messages, text messages, applications and other methods of communication;
  • Administer surveys, sweepstakes, contests and other promotional activities or events sponsored by us or our partners;
  • Manage our everyday business needs, such as Sites administration, forum management, fulfillment, analytics, fraud prevention, enforcement of our corporate reporting obligations, our Terms of Use or to comply with the law
4. When and Why MH Discloses Personal Information
  • We will not disclose your Personal Information to third parties except to:
  • Affiliated companies (such as our subsidiaries and other companies owned by or controlled by MH) who may only use the Personal Information for the purposes described in Section 3 above.
  • Our service providers that provide services for us such as shipping our products, sending emails on our behalf, maintaining our data on their servers and databases and processing payments. Our service providers are bound by law or contract to protect the Personal Information and are only allowed to use the Personal Information in accordance with the terms of our service agreements with them.
  • Third party merchants, but only to the extent you’ve participated in an offer, contest or other activity sponsored or offered through MH on behalf of that merchant. We may also provide merchants with Personal Information to combat fraud and as part of legal proceedings affecting MH and that merchant.
  • Third party services providers whom we may rely on to run or help us to run contests and surveys. In some instances, navigation to their websites may be seamless, so it may appear that you’re still on one of the Sites. So, please take note of who’s running the event in question and what terms, conditions and policies apply.
  • MH business partners or advertisers, as part of an offer, contest, or other activity that is provided by or in conjunction with MH and its business partners and in which you’ve elected to participate. For example, if you’re referred to MH from a business partner's website or through an invitation facilitated by or in conjunction with a MH business partner, we may provide that business partner with Contact Information and Transactional Information to validate the referral and to support the terms of the relationship between us and that business partner. This is turn may allow that business partner to contact you directly and/or to advertise to you.
  • Effect a merger, acquisition or otherwise; to support the sale or transfer of business assets; to enforce our rights or protect our property; to protect the rights, property or safety of others, investigate fraud, respond to a government request; or, as needed for support auditing, compliance and corporate governance functions. We may also disclose Personal Information to defend ourselves in litigation or a regulatory action and when required or advised to do so by law or our legal counsel in their representation of us, such as but not limited to, response to a subpoena or similar legal process, including to law enforcement agencies, regulators, and courts in Australia and other countries. If MH is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified by email and/or prominent notice on our Site of any changes in ownership or uses of your Personal Information, as well as of any choices you may have regarding your Personal Information.
  • We encourage our third party merchants and business partners to adopt and post their own privacy policies, since they are NOT covered by or governed by ours. So, the use of your Personal Information by such parties is governed by their privacy policies and is NOT subject to our control. We may also disclose information about you that is not personally identifiable. For example, we may provide our merchants, business partners, or other third parties with reports that contain aggregated and statistical data about our users.
5. Cookies and Related Technologies.
When you use the Sites, we collect certain information by automated or electronic means, using technologies such as cookies, pixel tags, clear gifs (also known as web beacons and web bugs), browser analysis tools and web server logs. As you use the Sites and applications, your browser and other devices, like certain types of tablets, communicate with servers operated by us, our business partners and services providers, to coordinate and record the interactivity and fill your requests for Products, services and information. The information from cookies and related technology is stored in web server logs and also in web cookies kept on the computers from which you access the Sites. This information is then transmitted back to the Sites by these computers. These servers are operated and the cookies managed by us, our business partners or our service providers. For example, when you visit the Sites, MH and our service providers may place cookies on that computer or device. Cookies allow us to recognize you when you return and to track and target your interests in order to provide a customized experience. They also help us to detect certain kinds of fraud. A "cookie" is a small amount of information that a web server sends to your browser. It stores information about your account, your preferences and your use of the Sites. Some cookies contain serial numbers that allow us to connect your Sites activity with other information we store about you in your profile or as related to your interactions with the Sites. Some cookies are temporary, whereas others may be configured to last longer. "Session" cookies are temporary cookies used for various reasons, such as to manage page views. Your browser usually erases session cookies once you exit your browser. "Persistent" cookies are more permanent cookies that are stored on the computers or other devices you use even beyond when you exit your browser. We use persistent cookies for a number of purposes such as, but not limited to, retrieving certain information you’ve previously provided (like your user i.d. if you asked to be remembered) and storing your preferences, such as the types of Products you’ve told us you are interested in. Pixel tags are tiny graphic images placed on website pages or in our emails that allow us to determine whether you’ve performed certain specific actions. When you access these pages or open our email messages, the pixel tags generate a notice of that action to us and/or our service providers. These tools allow us to measure response to our communications and improve our web pages and promotions. We collect many different types of information from the devices you use to access the Sites, using these cookies and other technologies. Some examples of this information are your operating system type, browser type, domain and other system settings, the language your system uses and the country and time zone of your device. Browsers routinely send these types of information to web servers. Our server logs also record the Internet Protocol ("IP") addresses of the devices you use to interact with the Sites. An IP address is a unique identifier that devices use to identify and communicate with each other on the Internet. We may also collect information about the website you were visiting before you came to the Sites and the website you visit after you leave the Sites, if this information is supplied to us by your browser. In many cases, the information we collect using cookies and other technologies is used in non-identifiable ways, without any reference to Personal Information. For example, we use information we collect about users of the Sites to optimize the Sites and understand its traffic and usage patterns. Another example is we associate the information we collect using cookies and related technologies with Personal Information. In that case, this Privacy Policy governs how we use that information. MH has relationships with third party advertising companies to place advertisements on our behalf onto other websites we don’t own or control and to perform tracking and reporting functions for the Sites and our advertisements. We don’t share Personal Information with third party advertising companies. However, these third parties may automatically collect information about your visit to the Sites and other websites, your IP address, your ISP and the browser you use to visit the Sites. They do this by using cookies, clear gifs and other technologies. A “clear gif” is a nearly invisible, pixel-size graphic image on a website page, website-based document or email. It helps us do things like view the URL of the page on which the clear gif appears and the time our Site and the email in questions is viewed. In emails, clear gifs help us confirm the receipt of and respond to our emails including but not limited to, those that you forward to friends and family, as well as help us deliver a more personalized online experience. Information collected may be use, among other things, to deliver advertising targeted to your interests and to better understand the usage and visitation of the Sites and the other websites tracked by these third parties. This Privacy Policy does NOT cover the collection methods or use of the information collected by these third parties and MH is NOT responsible for cookies, clear gifs or other technologies in third party ads. We encourage you to carefully review the privacy policies or statements of these third party advertising companies to learn more about their use of cookies and other technologies. If you’d like more information about this practice and to know your choices about not having this information used by third party advertisers, please visit Network Advertising Initiative at www.networkadvertising.org. They’re a cooperative of online advertising companies. You can opt-out of being targeted by certain third party advertising companies online at www.networkadvertising.org/consumer/opt_out.asp or at http://preferences.tmste.com/truste/. You can also rid your computers of cookies by blocking or deleting them. This is often done by adjusting your browser’s privacy and security settings. How to do this depends on the type of browser you use. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available. You might also find information about this by clicking your browser’s “Help” tab, or by contacting them. You can also try typing something like “deleting cookies” and your browser type into an internet search engine.
6. Your Choices
We think that you benefit from a more personalized experience when we know more about you and the kinds of products and services you like. However, you can limit the information you provide to MH and you can limit the communications that MH sends to you. You can manage your email preferences by logging into your account through our Site, entering the "My Account" section, and selecting "Manage Email Subscriptions." You can also manage your subscriptions by following subscription management instructions contained in some of the commercial messages that we send you. You may choose to subscribe or unsubscribe to some or all types of messages. You can update your subscription preferences whenever you want. Please note that even if you unsubscribe from promotional email messages, we may still need to contact you with important transactional information related to your account and your purchases. For example, even if you have unsubscribed from our promotional email messages, we will still send you confirmations when you purchase Products from us. You may manage how your browser handles cookies and related technologies by referring to the eighth (8th) and tenth (10th) paragraphs of section 6 above. You can also manage the sharing of certain Personal Information with us when you connect with us through a social media platform or application, such as through Facebook Connect. Please refer to the privacy settings of the social media website or application to determine how you may adjust our permissions and manage the interactivity between MH and that social media account. If you wish to opt out of receiving offers directly from MH merchants or business partners, you can follow the opt-out instructions in the emails that they send you.
7. Accessing and Correcting Personal Information
Keeping your Personal Information current and accurate helps ensure that we offer you the types of Products and other products and services we think you want form us, our merchants and business partners. You can do several things to help keep your Personal Information current and accurate. You can access, update and delete your Contact Information, Financial Account Information and the other information you provided to use in your profile or request that we no longer use your information to provide you Products or other products and services, you can do so by logging into and accessing the "My Account" section of our Site, sending us an email at privacy@murchison-hume.com. or by postal mail, phone or fax at the address at the end of the next sentence. While we’re ready to assist you in managing your Personal Information or closing your account, we can’t always delete records of past interactions and transactions. For example, we’re required to retain records relating to previous purchases on the Sites for financial reporting and compliance reasons. We’ll retain your information for as long as your account is active, to provide you Products and other products and services, to maintain a record of your transactions for financial reporting purposes and otherwise as we feel is necessary to comply with our legal obligations, resolve disputes and enforce our agreements.
8. Security of Personal Information MH has implemented an information security program that contains administrative, technical and physical controls designed to reasonably safeguard Personal Information. For example, we and our third-party payment processor each use industry-standard encryption technology to secure Financial Account Information when it is being transmitted over the Internet. When our employees need to access your Personal Information in the course of providing our Products to you, we track it internally. When our third-party providers, like our credit card processing provider and shipping provider, need to access your Personal Information in the course of providing our Products, they can only do so with a password we’ve provided them for this purpose. However, despite our security program and procedures, you understand and agree that we CAN’T GUARANTEE that any person will be prevented from obtaining Personal Information or any other information including but not limited to, through unauthorized means.
9. Notice to Residents of Countries outside the U.S.
MH is headquartered in the U.S. Personal Information may be accessed by us or transferred to us in the U.S. or to our affiliates, business partners, merchants or service providers elsewhere in the world. This also means that your Personal Information may be stored by us outside the province, state and/or country where you reside. By providing us with Personal Information, you consent to this transfer and storage. We’ll protect the privacy and security of Personal Information according to our Privacy Policy, regardless of where it is processed or stored.
10. Privacy Practices of Third Parties
This Privacy Policy ONLY addresses the use and disclosure of information by us through your interaction with the Sites. Other websites that may be accessible through links from the Sites may have their own privacy statements and personal information collection, use, protection and/or disclosure practices. We are NOT responsible and do not control the web or other practices of any third parties. Our affiliates, business partners, merchants or service providers may have their own privacy policies too. We encourage you to read carefully and be familiar with the privacy policies provided by these other parties prior to providing them with any information or taking advantage of any of their offers or promotions. MH is NOT responsible for the privacy or security of any information you provide to these third parties.
11. Communities The Sites may contain or be linked to online or other communities, social media pages and accounts and other areas where you may be able to publicly post information, make comments and communicate with others, such as such as Twitter, Facebook, discussion boards, chat rooms and blogs, review products and merchants and submit media content (individually and collectively “Communities”). Prior to posting in any of these areas, please read our Terms of Use carefully. All the information you post will be accessible to anyone with Internet access and any Personal Information you include in your posting may be read, collected and used by others. For example, if you post your email address along with a product review, you may receive unsolicited messages from other parties. You should avoid publicly posting your Personal Information. If you have questions about Personal Information posted in our Communities, please contact privacy@murchison-hume.com.
12. Facebook Connect
MH offers Facebook users the opportunity to interact with friends and to share on Facebook using Facebook Connect. If you’re logged into both MH and Facebook, when you use our Site's Facebook connection functions, your Facebook account will be linked with your MH account if the email addresses match. If the email addresses don’t match, we ask you if you want to link them and you must validate that you control the accounts. If you’re already logged into MH but not logged into Facebook, when you use out Site's Facebook connection functions, you’ll be prompted to enter your Facebook credentials or to sign up for Facebook. By proceeding through any of these scenarios, you grant MH permission to access your Facebook profile information and to use it in accordance with the Facebook terms of use and this Privacy Policy. If you’re not currently registered as a MH user and you use our Site's Facebook connection functions, you’ll first be asked to enter your Facebook credentials and then be given the option to register and join MH. Once you register with MH and connect with Facebook, you’ll be able to automatically post recent MH activity back to your Facebook wall. Please refer to the privacy settings in your Facebook account to manage the performance of your Facebook account.
13. Changes to this Privacy Policy
From time to time, we may update this Privacy Policy to clarify our practices or to reflect new or different privacy practices, such as when we add new features to our Site. If we make any material changes, we’ll notify you by email (sent to the email address specified in your account) or by means of a notice on our Site’s home page and a link to the updated Privacy Policy so you can read it. We also encourage you to periodically review this Privacy Policy page for the latest information about our privacy practices.
